Park regulations

A warm welcome!

A couple of hours of discovery and experience are about to begin for you. Despite all the fun, we ask you not to disregard the usual consideration and caution. Above all, this means showing responsibility for yourself and others and not ignoring the rules of courtesy. Safety is the top priority at Heide Park Resort. You can support our endeavours in this regard by observing the following rules of our park and company regulations. These apply exclusively to your use of the Heide Park Resort and to all transactions between visitors to the resort and Heide-Park Soltau GmbH.

 

1. Services

 

The premises of Heide Park may only be entered with valid admission tickets and annual passes or valid Merlin Abenteuer Passes at the designated entrances for visitors. Admission tickets must be kept during the visit and presented on request. The admission ticket entitles the holder to use all services offered at the time of the visit for which no separate charge is made. Services for which a separate charge is made are indicated accordingly. All authorisations acquired with the admission ticket expire when you leave the park premises. Re-entry on the same day is only possible with a valid hand stamp. Opening hours are subject to change without prior notice.

 

2. Failure of services

 

At the time of the visit, there is no guarantee that all services offered will be complete and/or operational. Heide-Park Soltau GmbH reserves the right to temporarily suspend individual services due to repairs, TÜV inspections, force majeure and/or unsuitable weather conditions. The entrance fee will not be refunded, whether in full or in part. Unavailable individual services will be announced immediately by Heide Park Soltau GmbH in the ‘Heide Park Resort’ app and at the location of the service. Persons under the influence of alcohol or drugs may be denied access to the park or may be expelled from the park premises.

Even after general legalisation, the consumption of cannabis is not permitted on our premises, also in consideration of the many families with children.

An offence against the property rights may result in a ban from the premises.

 

3. Parking

 

The rules and signs of the German Road Traffic Regulations (StVO) apply in our car parks. In order to ensure trouble-free traffic, the instructions of our stewards in the car parks must be strictly observed. Only park your vehicle in the designated parking areas. If you park your vehicle outside the car park and thereby obstruct traffic, we will have to order the vehicle to be towed away at your risk and expense. The parking fee is charged for the parking space provided (car park), but not for guarding the vehicle. Therefore, when leaving your vehicle, please ensure that you have closed the doors, boot, windows and sunroof and do not leave any objects in the car. We also ask you not to leave any animals in the vehicle. Heide-Park Soltau GmbH is not liable for theft of or damage to your vehicle by others. This also applies if damage is caused by storm, fire, hail, explosion and other extraordinary events. The exclusion of liability for compensation does not apply if the damage is caused by gross negligence or wilful intent on the part of Heide-Park Soltau GmbH employees. Vehicle licence plates are stored for the duration of parking. In addition to claims for damages under civil law for wilful damage to the barrier system, we will also bring criminal charges.

 

4. Resale of tickets, contractual penalty

 

The ticket purchaser is not permitted to resell tickets: to sell tickets at a higher price than the Heide Park's retail price; this applies in particular also in the context of a private transfer; to sell tickets for business or commercial purposes without the express prior written consent of the Heide Park; to use tickets in the context of prize draws, travel or hospitality offers or publicly for advertising or marketing purposes without the prior written consent of the Heide Park; to offer tickets for sale commercially at internet auction houses themselves or through third parties; to offer tickets for sale commercially on other, unauthorised internet platforms themselves or through third parties; to pass on tickets without express reference to these T&C, in particular this section, even if passing them on is not prohibited under this regulation.

Heide Park is entitled to demand a contractual penalty of up to twice the admission price per ticket sold per violation from ticket purchasers who pass on and/or offer tickets commercially in violation of these provisions.

The number of offences shall be determined by the number of tickets offered, sold, passed on or used.

In the event of an offence against the aforementioned prohibitions, the ticket loses its validity and no longer entitles the holder to visit Heide Park. Heide Park also reserves the right to refuse future ticket purchases to persons who violate the above prohibitions on resale and/or to initiate further civil and/or criminal proceedings.

 

5. General safety regulations

 

Dogs are welcome guests, but must be kept on a short lead. Dogs are not allowed in show performances, rides and specially marked areas of the park. Dog faeces must be picked up. You can obtain a free dog hygiene kit from our Service Centre. Other pets are not allowed in the park.

The fire regulations on the park grounds must be strictly observed. Barbecues are prohibited on the entire park grounds. Smoking is prohibited while using all attractions. This also applies in the queuing areas and restaurants as well as during shows, performances and/or large gatherings of people.

We take the ‘Law for the Protection of Young People’ very seriously. Anyone who does not comply with this can be expelled from the resort premises without the right to a refund of the entrance fee. Visitors are not allowed to leave the paths. Safety grids, safety barriers, fences and walls may not be climbed over under any circumstances. Lawns may not be walked on.

Heide-Park Soltau GmbH is not liable for damage caused by accidents outside the public path markings and on the specially marked company and staff paths due to a breach of its duty to ensure safety.

The carrying of weapons or dangerous objects (guns, knives, chains, brass knuckles, etc.), fireworks, bottles, cans and intoxicants is not permitted on or in front of the Heide-Park Soltau GmbH site.

The instructions of Heide Park staff must be followed in the interests of safety and the smooth and orderly running of the park. The wilful making of noise and the loud operation of music equipment are prohibited. Outerwear must be worn. Bicycles, balance bikes, tricycles, scooters, skateboards, roller skates, sledges etc. are not permitted for safety reasons.

Due to unsuitable weather conditions (rain, freezing rain, snowfall, etc.) or splashing water on the water rides, there may be a risk of slipping in the park. Guests are therefore advised to exercise the necessary caution and care in the entire park area and to wear non-slip and closed footwear, to refrain from walking and running fast and to use the handrails provided. There is an absolute ban on swimming and walking in all water areas.

Furthermore, for your own safety, it is necessary to wear sturdy footwear when using the rides (e.g. trainers, sneakers or sandals that are closed at the back). It is important that the shoe cannot slip off the foot even at speed and offers sufficient support in the event of an evacuation. Flip flops or shoes that are open at the back are therefore not suitable. Our staff on the rides can refuse visitors a ride in this case.

It is possible to ride barefoot on some rides - however, Heide Park accepts no liability for injuries that may occur in the event of an evacuation.

 

6. Use of the facilities and attractions in the leisure park, behaviour and clothing

 

The facilities in the leisure park are available to you within the scope of the respective usage restrictions. Please follow the instructions of the staff. If you wilfully and knowingly disregard the instructions for use and restrictions on use as well as the instructions of the staff, the staff may exclude you from using the attraction without this giving rise to a claim for compensation on your part. This also applies if you try to jump the queue. Please understand that not all rides are suitable for every visitor. You can read the restrictions for use on our website, on the boards at the entrance and on the information boards at the individual rides. The restrictions on use are stipulated by the TÜV and the manufacturer of the respective attraction and have been put in place for your protection.

You are liable for all damage caused by disregarding the instructions for use or restrictions on use, by negligence or wilful intent.

If the power supply is interrupted due to thunderstorms, storms or other events and individual facilities and attractions fail as a result, no refund or partial refund of the admission fee paid can be demanded.

In the event of strong winds, obstructed visibility, thunderstorms or special weather conditions, we are obliged to suspend the operation of individual facilities and attractions in order to protect visitors. There is no entitlement to a refund of the admission paid if individual attractions are cancelled for the above-mentioned reasons, not even partially.

Individual facilities and attractions that are not in operation due to force majeure or for safety reasons will be announced at the respective attraction, in the Heide Park app and at www.heide-park.de. In order to ensure a family-friendly excursion, every visitor is required to observe the following rules of behaviour and dress:

We ask every guest to respect the interests of other guests and employees and to base their behaviour on generally accepted principles. This includes following the instructions of resort staff and observing signs and not entering the resort unclothed or only partially clothed (e.g. without outerwear).

When visiting the Heide Park Resort, we do not tolerate clothing that is marked to defame people on the basis of their skin colour, religion, origin, gender or sexual orientation, or that shows anti-constitutional or, according to recognised opinion, immoral right-wing extremist or xenophobic symbols; the same applies to visible body signatures of this kind.

In principle, no clothing that is explicitly sexual or sexualised fetish is tolerated when visiting the Heide Park Resort. Persons who violate these regulations may be asked to change their clothing or may be denied access to the resort or may be expelled from the resort and lose any right to a refund of the admission fee and payment of any claims for damages. Heide Park Soltau GmbH reserves the right to take further legal action.

 

7. Use of the playgrounds

 

The use of playground equipment, playing fields and similar facilities is at your own risk. The use of playground equipment by persons over the age of 12 is prohibited. Parents are liable for their children if they fail to fulfil their duty of supervision.

 

8. Duty of supervision

 

Children under the age of 16 must always be accompanied by a supervising adult. We advise all parents and persons accompanying groups to carefully fulfil their duty of supervision, as we cannot release them from this obligation. In this context, supervisors and parents are also responsible for any damage caused by those being supervised if they fail to fulfil their duty of supervision.

Children/young people under the age of 16 may only participate on days with an evening programme beyond 8 p.m. (after 4 p.m.) if accompanied by a supervising person.

 

9. Limitations of liability

 

The stay in and in front of the Heide Park Resort as well as at the individual attractions and facilities is at your own risk.

We are liable for all damage caused by culpable breach of a material contractual obligation or due to gross negligence or intent.

In the event of a breach of a material contractual obligation without gross negligence or intent, we shall not be liable for unforeseeable and atypical damage. Our liability for injury to life, limb or health and under the Product Liability Act, for fraudulently concealed defects and for the assumption of a guarantee for the quality of an item remains unaffected.

Heide-Park Soltau GmbH is not liable for the loss of or damage to items handed over to park staff or left on the park premises, except in cases of intent or gross negligence.

No liability is accepted for any items, including mobile phones, cameras, jewellery, shoes, etc., that are damaged, destroyed or lost while using an attraction.

Valuables can be safely stored in our lockers for a fee.

The services of the park's own first aid service do not replace any medical treatment that may be necessary.

 

10. Damage reports

 

All facilities in the park are carefully maintained and monitored. Should you nevertheless suffer damage through no fault of your own (this includes damage to property, personal injury and other damage), please report the damage to the Service Centre before leaving the park premises. Please also notify the Service Centre if there is reason to believe that an incident may result in damage at a later date.

 

11. Advertising and offering goods and services

 

Advertising, as well as the offering and marketing of goods and services on the entire car park area, including the car parks and the areas in front of the entrances, are only permitted with the prior written consent of the management. This also applies to the conducting of opinion polls and counts. Advertising and rallies for organisations, associations, interest groups and personal ideas by any means whatsoever are prohibited on the park grounds and inside all buildings and rides etc. and will be punished in each individual case with expulsion from the park, civil claims and criminal charges for trespassing.

 

12. Film and photo shoots

 

Your film and photo recordings for private purposes at Heide Park Resort are only permitted in the publicly accessible guest areas. Film and photo shoots during the ride (especially in the major rides) are not permitted. The use of cameras such as GoPros and mobile phone cameras during the ride is also strictly prohibited for safety reasons. This includes the use of chest straps, helmet cameras and professional camera mounts. Staff are instructed to prevent such recordings. 

All visitors are prohibited from using drones on our entire premises (including in the car parks and in the Holiday Camp) for safety reasons and out of consideration for our guests (personal rights/right to image).

Filming for commercial purposes and filming for TV reports requires a filming permit from the Heide Park Resort PR department and must always be accompanied. 

In the event of violations of the prohibition of filming and photography, we will exercise our domiciliary rights with the consequence that the person acting in violation of the prohibition may be expelled from the park grounds and may be issued a comprehensive ban from entering the entire Heide Park Resort in the future.

For privacy and data protection reasons, it is expressly forbidden to take photographs of Heide Park staff. Unauthorised photos must be deleted on request.

Film and photo recordings are made at the Heide Park Resort. The areas/attractions are labelled as far as possible. Please avoid these areas if you do not wish any photographs you may have taken to be used later in public or inform the photographer/film team accordingly. If this is not done, we will assume that utilisation is permitted free of charge.

 

13. Data protection

 

All personal data is protected in accordance with data protection regulations, in particular the GDPR and the Federal Data Protection Act.

In the event of violations of the parking regulations, the person committing the offence must present their identity card or passport as proof of identity if a ban is to be issued. Persons who are banned from entering the Heide Park Resort are listed in a no-entry list. The no-entry list only contains data that is necessary for the clear identification of the persons and thus for the enforcement of any no-entry orders issued. These are usually Name, address, date of birth, place of birth. The data is stored on the basis of Art. 6 Para. 1 f) GDPR, as we have a legitimate interest in identifying the person concerned and monitoring the enforcement of the house ban in the event of violations of house rules. Personal data that is stored in the event of violations of the parking regulations or when house bans are issued will be deleted immediately if it is no longer required to achieve the purpose for which it was collected or if the interests of the data subject worthy of protection prevent further storage.

 

14. Video surveillance

 

Parts of the publicly accessible areas in the Heide Park Resort are video-monitored for your safety and to safeguard domiciliary rights. Video surveillance is based on Art. 6 para. 1 f) GDPR. The video-monitored areas are labelled with corresponding signs. Further information can be found in our video surveillance information sheet, which you can download from our website. If image material is stored, this data will be deleted immediately if it is no longer required to achieve the purpose for which it was collected or if the interests of the data subjects worthy of protection prevent further storage.

 

15. Property rights

 

Anyone who causes a nuisance to other visitors, uses the facilities contrary to the existing usage instructions and restrictions, does not comply with the instructions of the staff, these park regulations or mandatory signs and causes a nuisance in any other way may be expelled from the park grounds without any entitlement to a refund of the entrance fee.                 

In addition, Heide-Park Soltau GmbH is entitled to issue a warning or a comprehensive ban on entering the entire Heide Park Resort to persons who violate the park rules or who are found on the park grounds without a valid admission ticket. Persons who enter the park premises despite a ban on entering the premises are liable to prosecution for trespassing in accordance with § 123 of the German Criminal Code (StGB).

 

16. Place of fulfilment, place of jurisdiction

 

The place of fulfilment for payment, delivery and performance is the registered office of Heide-Park Soltau GmbH, Lüneburg Local Court.

 

17. Applicable law, collateral agreements, contact

 

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. There are no verbal collateral agreements.

Should individual points of these park regulations be or become invalid, unenforceable or unenforceable in whole or in part, this shall not affect the validity of the contract and the remaining provisions.
